Lawyer in Maynaguri
Satyajit Paul, Advocate · Calcutta High Court, Circuit Bench at Jalpaiguri
Maynaguri (ময়নাগুড়ি), across the Teesta from Jalpaiguri town, is part of the Jalpaiguri Sadar subdivision, and its cases are heard in the same town as the Circuit Bench of the Calcutta High Court, where Satyajit Paul practises. This page explains where Maynaguri cases are filed and the kinds of matters that come up there.
This page is general information about courts and procedure, published in keeping with Bar Council of India rules, which permit an advocate's website to state his areas of practice. It is not legal advice and does not create a lawyer-client relationship.
Maynaguri town and block
Maynaguri lies on the Jarda river, about 10 km north-east of Jalpaiguri town, and is often called the gateway to the Dooars. It became a municipality on 6 July 2021 and is the headquarters of the Maynaguri community development block, which falls in the Jalpaiguri Sadar subdivision. Maynaguri police station covers the block. The Jalpesh temple, about 3 km from the town, and the road to Gorumara National Park bring large numbers of visitors.
Unlike Dhupguri, which became a separate subdivision in 2024, Maynaguri remains with Jalpaiguri Sadar, so both its executive offices and its courts are in Jalpaiguri town.
Maynaguri court: where cases go
There is no court sitting at Maynaguri. What people call the Maynaguri court is, in practice, the Jalpaiguri district court.
- Criminal cases: the Jalpaiguri judgeship's police-station-wise list groups Maynaguri police station with Kotwali, Rajganj and the other Sadar stations, so FIRs from Maynaguri come before the Chief Judicial Magistrate's establishment at Jalpaiguri and are distributed among its magistrates. Offences triable by a Court of Session are committed to the Sessions and Additional Sessions Judges in the same building.
- Civil suits about land or houses at Maynaguri start in Jalpaiguri, in the junior or senior civil judge's court depending on what the suit is valued at.
- Matrimonial suits under the Hindu Marriage Act go to the District Judge's court at Jalpaiguri; a wife's or child's claim for maintenance under section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) is a magistrate's matter.
- Consumer complaints are filed before the District Consumer Disputes Redressal Commission at Jalpaiguri, which hears complaints valued up to fifty lakh rupees under the 2021 pecuniary-jurisdiction rules made under the Consumer Protection Act, 2019, within two years of the cause of action (section 69).
The Jalpaiguri court complex
The district court is the Nawabbari Court Complex on Merchant Road, Jalpaiguri (PIN 735101). The judgeship states that fourteen courts function in the Sadar subdivision: the Principal District and Sessions Judge, four Additional District and Sessions Judges, two Additional District and Sessions Judges (Fast Track Courts), a Civil Judge (Senior Division) who is also Assistant Sessions Judge, the Chief Judicial Magistrate, three Judicial Magistrates and two Civil Judges (Junior Division). For someone from Maynaguri the trial court, the High Court and an advocate's chamber are all within a short distance of each other.
Land acquired for roads and railways
Maynaguri sits on the National Highway 27 corridor and on the rail line through New Maynaguri station, and land in the block has been taken for highway and railway work. Compensation for land acquired by the government is governed by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, which sets out how the market value, the solatium and rehabilitation entitlements are worked out. A landowner who does not accept the award may seek a reference to the authority constituted under that Act, and its decisions can be taken further to the High Court. Disputes over whether a particular plot was lawfully acquired, or over delay in paying the award, are often raised by writ petition.
Other common matters
- Riverside land: possession and boundary disputes over land along the Teesta and Jarda, where erosion and new deposits change the ground over time.
- Partition and title suits among heirs, and corrections to the record of rights.
- Leases and tenancies of shops and premises in the growing municipal area.
- Criminal cases and bail, including anticipatory bail where a complaint is threatened.
- Family matters: divorce, maintenance, custody and Domestic Violence Act applications.
The High Court next door
The Calcutta High Court's Circuit Bench at Jalpaiguri hears High Court work from Jalpaiguri, Alipurduar, Cooch Behar, Darjeeling and Kalimpong districts. For Maynaguri this means appeals from the Jalpaiguri courts, High Court bail and anticipatory bail (sections 483 and 482 BNSS), quashing petitions (section 528 BNSS), criminal appeals (section 415 BNSS), civil appeals and revisions (sections 96, 100 and 115 of the Code of Civil Procedure), and writ petitions under Article 226 of the Constitution are all heard about 10 to 15 km from home, a short trip across the Teesta.
Matters handled
At the Circuit Bench, Satyajit Paul takes up Maynaguri matters of these kinds: writs about land acquisition awards, land records, service conditions and police inaction; anticipatory and regular bail; petitions to quash proceedings; appeals and revisions on both the civil and criminal side; matrimonial appeals; and drafting of notices, agreements and deeds.
