Lawyer in Kalimpong
Satyajit Paul, Advocate · Calcutta High Court, Circuit Bench at Jalpaiguri
Kalimpong is one of the newest districts in West Bengal, and its court set-up changed with it. This page explains, in general terms, which court now serves Kalimpong, how a Kalimpong case reaches the Calcutta High Court, Circuit Bench at Jalpaiguri, where Satyajit Paul practises, and the matters in which he accepts briefs from the district.
This page is general legal information about Kalimpong, published in keeping with Bar Council of India rules, which permit an advocate's website to state his areas of practice. It is not legal advice and does not create a lawyer-client relationship. Court arrangements change from time to time; confirm the current position with the court concerned.
A district since 2017
Kalimpong was a subdivision of Darjeeling district from 1916 until February 2017, when the state government separated it to form a new district. The district consists of the Kalimpong municipality and the rural blocks of Kalimpong I, Pedong, Lava and Gorubathan; Pedong and Lava were formed in 2021 by splitting the old Kalimpong II block. Gorubathan, on the southern slopes, looks down towards the Dooars and is much closer to Malbazar than to Kalimpong town, but it is in Kalimpong district for court purposes. Like the Darjeeling hills, Kalimpong is within the area of the Gorkhaland Territorial Administration.
Becoming a district did not by itself give Kalimpong a district judge. That came a year later, which is why older papers, and some people, still treat Darjeeling as the court for Kalimpong.
Which court serves Kalimpong now
A separate Kalimpong district judiciary and sessions division was inaugurated on 17 March 2018. Since then the District and Sessions Judge, Kalimpong has been the principal civil and criminal court for the district. In practice this means:
| Matter | Where it goes now |
|---|---|
| Sessions trials, civil appeals from the civil judges, matters reserved by law to the District Judge | District and Sessions Judge, Kalimpong |
| Magistrate-triable criminal cases, bail before a magistrate, maintenance and domestic-violence applications | Additional Chief Judicial Magistrate and Judicial Magistrate at Kalimpong |
| Ordinary civil suits | Civil Judge at Kalimpong |
| Cases from the Gorubathan area | The court at Gorubathan, or the Kalimpong courts, depending on the nature of the case |
| Appeals, revisions, writs, High Court bail | Calcutta High Court, Circuit Bench at Jalpaiguri |
The Kalimpong court building stands in the Court Compound below the office of the Sub-Divisional Officer. In April 2024 vulnerable-witness deposition centres were opened in the district court at Kalimpong and in the Gorubathan court, so that children and other vulnerable witnesses can give evidence away from the accused.
How the Kalimpong court grew
The court in Kalimpong has a longer history than the district. A civil court of the Munsif started on 1 December 1948 in a rented house called "Nirmalaya" at 9th Mile, under the judgeship of the District Court at Jalpaiguri. A permanent Munsif's court followed in 1970, and Kalimpong stayed under the Jalpaiguri judgeship until 1979. After a period in rented municipal premises from 1985, the present court building, housing the Additional Chief Judicial Magistrate and the Civil Judge (Junior Division) cum Judicial Magistrate, was inaugurated on 7 July 1997. The 2018 sessions division completed the move to a full district court.
Kalimpong cases in the High Court
Kalimpong is one of the five districts under the Calcutta High Court, Circuit Bench at Jalpaiguri. Matters that commonly go from Kalimpong to the Circuit Bench include:
- bail under section 483 and anticipatory bail under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and quashing petitions under section 528 of that Sanhita;
- criminal appeals against judgments of the Sessions Court at Kalimpong, and criminal revisions;
- civil appeals and revisions, and transfer petitions under section 24 of the Code of Civil Procedure, for example to move a matrimonial case between Kalimpong and a district in the plains;
- appeals against motor accident claim awards under section 173 of the Motor Vehicles Act, 1988;
- writ petitions under Article 226 of the Constitution against the state government, the district administration, the GTA or the municipality, including service and pension matters.
Matters that often arise in Kalimpong
- Land held on government lease. A good deal of land in and around Kalimpong town is held on lease from the government rather than as freehold, so transfers, mutation and building permission can depend on the terms of the lease and on government consent. Disputes over these often end in a writ petition rather than a civil suit.
- Family property in the hills. Partition of ancestral homes and orchards among large families, often with co-owners living outside the district.
- Road accidents on NH 10 and the hill roads, giving rise to claims before the Motor Accidents Claims Tribunal and appeals.
- Homestays and tourism: lease, partnership and consumer disputes.
- Service matters of teachers and employees of the state government and the GTA.

Kalimpong to Jalpaiguri
Kalimpong town is about 65 km from Siliguri by NH 10, which follows the Teesta valley down to Sevoke; Jalpaiguri is roughly 45 km beyond Siliguri. From the Gorubathan side the Dooars roads through Malbazar can be shorter. NH 10 is closed from time to time for landslides or repairs, so it is sensible to send the order under challenge and other papers to the chamber by WhatsApp or email first. The chamber is at Santipara Bus Stand, Jalpaiguri; he does not keep an office in Kalimpong.
