Satyajit Paul, Advocate · Calcutta High Court, Circuit Bench at Jalpaiguri
Falakata sits at the junction of National Highway 27 in Alipurduar district, and its High Court matters are heard at the Circuit Bench of the Calcutta High Court at Jalpaiguri, where Satyajit Paul practises. This page answers the question most people from Falakata and Jateswar ask first: which court will hear my case, and where is it?
This page is general information about courts and procedure, published in keeping with Bar Council of India rules, which permit an advocate's website to state his areas of practice. It is not legal advice and does not create a lawyer-client relationship.
Falakata on the map of courts
Falakata is a municipality (constituted in 2021) in the Alipurduar subdivision of Alipurduar district. It lies on National Highway 27, where roads branch towards Alipurduar and Cooch Behar, and has its own railway station on the line from New Jalpaiguri. The Falakata community development block around it covers about 354 square kilometres, and the whole block, including Jateswar, is served by Falakata police station.
Three different courts matter to a person from Falakata: the trial courts at Alipurduar, the High Court's Circuit Bench at Jalpaiguri, and, for a small number of matters, the Supreme Court in New Delhi.
Falakata court: where cases are heard
There is no court sitting at Falakata. All courts of Alipurduar district are located in Alipurduar town (District Court, Alipurduar, PIN 736122), roughly 30 to 35 km east of Falakata by road.
- Criminal cases: under the Alipurduar judgeship's police-station-wise list, cases from Falakata police station go to the Additional Chief Judicial Magistrate, Alipurduar. Serious offences are committed from there to the Court of Session in the same town.
- Civil suits about land, houses or money at Falakata are filed before the Civil Judge (Junior Division) or Civil Judge (Senior Division) at Alipurduar, depending on the value of the suit.
- Family cases: a divorce petition goes to the District Judge's court in Alipurduar, while claims for maintenance (section 144, Bharatiya Nagarik Suraksha Sanhita, 2023, or BNSS) and protection under the Domestic Violence Act are filed before its magistrates.
Allocations change from time to time, and the daily cause list on the district court's website shows where a case is actually listed.
Jateswar
Jateswar is a census town in the Falakata block, with two gram panchayats, Jateswar I and Jateswar II. Its college, Lilabati Mahavidyalaya, was set up in 2013. Jateswar has no police station of its own; it is policed from Falakata. For court purposes it is therefore treated exactly like Falakata town: an FIR from Jateswar travels to the Additional CJM's court in Alipurduar, and a dispute over a plot at Jateswar is a suit in the Alipurduar civil courts.
Cases filed before 2023
Although Alipurduar became a district in June 2014, its courts remained part of the Jalpaiguri judgeship until the separate District Judgeship of Alipurduar was created on 29 April 2023. Older Falakata cases may therefore have orders issued under the Jalpaiguri judgeship, and appeals filed before the split may have been decided at Jalpaiguri. When applying for certified copies of old records, it helps to know which judgeship held the case at the time.
Common matters from the Falakata area
- Highway cases. Falakata's position on National Highway 27 means road-accident cases, both criminal prosecutions and compensation claims under the Motor Vehicles Act, 1988, are frequent.
- Land. Partition among heirs, possession and boundary disputes over agricultural land, and record-of-rights corrections, especially in the villages that were brought into the municipality in 2021.
- Municipal matters such as building permission and mutation in the municipality's records, which can be challenged by writ petition where the authority acts unlawfully.
- Family matters: divorce, maintenance and custody.
- Small business disputes: Jateswar is known for wooden furniture, chira (flattened rice) and flour, and unpaid trade dues sometimes come with a dishonoured cheque, which is a complaint under section 138 of the Negotiable Instruments Act, 1881.
Taking a case to the High Court
Alipurduar district is within the jurisdiction of the Calcutta High Court, Circuit Bench at Jalpaiguri. From Falakata, the Bench is about 80 to 90 km west along National Highway 27, through Dhupguri and Maynaguri. Matters filed there include anticipatory bail (section 482 BNSS), bail after the Sessions Court has refused it (section 483 BNSS), quashing petitions (section 528 BNSS), criminal appeals against sessions convictions (section 415 BNSS), civil appeals and second appeals (sections 96 and 100 of the Code of Civil Procedure), revisions, and writ petitions under Article 226 of the Constitution. An appeal to the High Court must ordinarily be filed within ninety days of a civil decree or sixty days of a criminal conviction under the Limitation Act, 1963.
Matters handled
Matters from Falakata and Jateswar that Satyajit Paul takes up at the Circuit Bench include appeals against Alipurduar judgments, High Court bail and anticipatory bail, quashing petitions, writs against municipal, land and police authorities, matrimonial appeals and transfer petitions, and drafting. He has no Falakata office; hearings in the Alipurduar trial courts are conducted by advocates practising there.
Frequently asked questions
Is there a court in Falakata?
