Advocate in Dhupguri
Satyajit Paul, Advocate · Calcutta High Court, Circuit Bench at Jalpaiguri
Dhupguri, the potato and jute market town on National Highway 27, is in Jalpaiguri district and within the jurisdiction of the Circuit Bench of the Calcutta High Court at Jalpaiguri, where Satyajit Paul practises. This page explains what the new Dhupguri subdivision changed, which court hears Dhupguri cases today, and how High Court matters from the area are handled.
This page is general information about courts and procedure, published in keeping with Bar Council of India rules, which permit an advocate's website to state his areas of practice. It is not legal advice and does not create a lawyer-client relationship.
Dhupguri subdivision
For most of its history Dhupguri was part of the Jalpaiguri Sadar subdivision. A separate subdivision was promised in 2023, the West Bengal Legislative Assembly passed the proposal on 12 October 2023, and Dhupguri subdivision was formally constituted in January 2024. Jalpaiguri district now has three subdivisions: Jalpaiguri Sadar, Malbazar and Dhupguri. The Dhupguri subdivision includes Dhupguri municipality and the area of Dhupguri and Banarhat police stations; Banarhat police station runs up to the Bhutan border.
A new subdivision brings a Subdivisional Officer and executive offices to the town, which matters for certificates, land and land-revenue work and executive magistrates' proceedings. It does not by itself create a court. Courts are set up separately, by the State Government in consultation with the High Court.
Is there a court in Dhupguri?
As of October 2026 the Jalpaiguri judgeship's published list of judges shows no court sitting at Dhupguri. The district's courts sit at the Nawabbari Court Complex, Merchant Road, Jalpaiguri, with one Additional District and Sessions Judge at the Malbazar subdivisional court complex and a Railway Magistrate at New Jalpaiguri.
For criminal cases, the judgeship's police-station-wise list places Dhupguri and Banarhat police stations under the Jalpaiguri Sadar magistrates, that is, the Chief Judicial Magistrate and the Judicial Magistrates at Jalpaiguri. A person arrested by Dhupguri police is therefore produced before a magistrate at Jalpaiguri, and the case is tried there. Civil suits about property at Dhupguri are filed before the Civil Judges (Junior or Senior Division) at Jalpaiguri, according to their value. If a court is later opened at Dhupguri, pending and new cases may be reassigned; the court's cause list will show where a case is listed.
Trade disputes and cheque bounce
Dhupguri's regulated market, the Dhupguri hat, is one of the largest agricultural markets in West Bengal, and potatoes from the area go to Bihar, Assam, the north-east, Nepal, Bhutan and Bangladesh. Trade on credit leads to dishonoured cheques, and these are dealt with under the Negotiable Instruments Act, 1881:
- A written demand notice must be sent within thirty days of learning that the cheque has bounced (section 138).
- The drawer then has fifteen days from receipt of the notice to pay. If that period passes without payment, the payee has one further month in which to file the complaint (section 142(1)(b)).
- Territorial jurisdiction follows the payee's bank: where the cheque was presented through the payee's account, the case belongs to the magistrate for the place where that branch is (section 142(2)). For a cheque paid into a bank at Dhupguri, that is at present the magistrates sitting in Jalpaiguri.
- During the trial the magistrate can direct interim compensation of not more than one-fifth of the cheque value (section 143A); if the drawer is convicted and appeals, the appellate court can require a deposit of no less than one-fifth of the fine or compensation (section 148).
Sales disputes that do not involve a cheque, such as unpaid consignments or cold-storage claims, are civil money suits; and a buyer of defective seed, fertiliser or equipment may in some cases approach the District Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
Land and agricultural disputes
Most Dhupguri families hold paddy, jute or potato land, and the usual civil disputes are partition among heirs, boundary and possession disputes, and suits for declaration of title and injunction. Corrections to the record of rights and mutation go first to the land and land-revenue authorities; their orders can be appealed within that department, and where the authority acts without jurisdiction or refuses to decide, a writ petition may lie before the High Court.
High Court matters from Dhupguri
Because the Circuit Bench sits in Jalpaiguri, High Court work from Dhupguri is filed in the same town as the trial courts. The usual matters are anticipatory bail (section 482, Bharatiya Nagarik Suraksha Sanhita, 2023) and bail after rejection by the Sessions Court (section 483); quashing petitions (section 528); criminal appeals from sessions convictions (section 415); civil first and second appeals (sections 96 and 100, Code of Civil Procedure) and revisions; and writ petitions under Article 226 of the Constitution against public authorities, including the new subdivisional offices.
Matters handled
Satyajit Paul's work for people from Dhupguri and Banarhat is at the High Court level: revisions and appeals arising out of cheque-dishonour and consumer cases, bail in the High Court and pre-arrest bail, quashing of FIRs, civil and criminal appeals, and writs over land records, service questions and police inaction. He also drafts demand notices and agreements for traders.
